Fusus/Axon agreements and integrated-camera video policies
Hello,
Please log this written request with the city's FOI intake and route it to the appropriate record holders. Please use this email address for correspondence and delivery.
Under the Connecticut Freedom of Information Act, including Conn. Gen. Stat. §§ 1-210(a), 1-211(a) and 1-212, I request electronic copies of the following existing records.
This request concerns NHPD's use of Fusus/FususONE to integrate city and participating private-camera video.
- The executed Fusus agreement authorized by LM-2023-0412, including its order form, pricing schedule, incorporated exhibits and data-processing/privacy terms, and subsequent amendments, renewals or termination documents through receipt of this request. The public order describes a three-year agreement effective January 1, 2024. Its fiscal statement identifies account 23143030-58704 as a search aid, not a restriction to that account. https://newhaven-ct.legistar.com/LegislationDetail.aspx?ID=6306143&GUID=364CB586-75CD-4AFA-92B4-61899B3D9B4D
- The executed Axon order form and pricing schedule implementing LM-2024-0628, together with the incorporated Fusus/FususONE-specific terms, applicable general data-processing terms, effective amendments, and any Fusus transition, credit or replacement schedule. Other product-specific technical exhibits are outside this item. The signed public order states $7,619,019.18; the revised fiscal statement states $7,731,551.86 and places Fusus maintenance in years three through five. I seek the executed records establishing the governing price and terms, rather than a new reconciliation report. https://newhaven-ct.legistar.com/LegislationDetail.aspx?ID=6901724&GUID=4C9FC650-7946-4C5C-AC37-6D8C01739721
- The current written policy or procedure and effective supplements governing NHPD's Fusus/FususONE live viewing, recorded-video searches, analytics, copying/exporting video or metadata, retention, deletion and preservation, vendor access, outside-agency access/disclosure, permitted/prohibited uses, and auditing. This includes police access to participating privately owned cameras. Please use versions effective on receipt, regardless of their creation date.
- The most recent city-held data description or adopted product specification identifying the video, audio, metadata and analytical outputs retained in the city's use of Fusus/FususONE, and the most recent existing administrative record showing applicable routine retention/deletion intervals. Include separately documented intervals for video, metadata and saved/exported clips. This seeks existing descriptions or administrative records, not actual footage, a new report or an inspection of the system.
- The current blank participation/consent agreement and incorporated privacy or data-use terms used when a private camera owner authorizes live integration through Connect New Haven. This concerns access, withdrawal of consent, use, retention and onward sharing. Completed owner forms and camera-registration records are excluded.
Please include incorporated contractual provisions governing ownership, vendor/subcontractor access and any secondary use or model-training use of city video or metadata. This does not assume that a particular use is permitted or occurs. If Fusus is no longer active under that name, please provide responsive transition documents and the records governing the successor service performing the same integration function.
The public checklists, cover letters, aldermanic orders, signature copies of those orders and fiscal statements already posted with the two files are excluded. Another copy of the published June 14, 2022 General Order 7.10 on body/dash cameras is unnecessary. Yale-specific camera-sharing instruments are outside this request.
Please search NHPD, IT and Finance/Purchasing records, including responsive administrative records the city maintains in its vendor-hosted service. No general email search, footage, private-owner identities, camera locations, individual accounts, credentials, network diagrams or system access are requested.
Please provide existing electronic files by email or download link, retaining searchable text where available. For records already online, direct links to the specific documents and versions are sufficient. Please acknowledge receipt, identify the contact handling the request, and provide available records promptly in installments if other items need more time. Please identify the numbered items answered by each production. If an item needs clarification, please identify it and continue processing the remaining items.
For any withholding or redaction, please identify the record or category, cite the specific statutory provision, and explain its application. Please release reasonably separable nonexempt portions. If no responsive records are located for an item, please say so and distinguish that result from withholding. If another city office maintains an item, please route it there or identify the custodian.
I request a fee waiver under § 1-212(d)(3) because disclosure would benefit public understanding of public spending and the rules governing city access to camera data. If fees would apply, please provide an itemized estimate and the legal basis, and obtain my written approval before incurring any charge. Please continue with records that can be provided without charge.
